1. Who we are
thephonepurse.com (the "Site") is operated by ThePhonePurse LLC, 1801 Century Park West, Los Angeles, CA 90067, USA ("The Phone Purse", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
2. Eligibility
You must be at least 18, or the age of majority where you live, to place an order, or have a parent or guardian's permission.
3. Products
We sell crossbody phone cases and accessories. Our cases are made of faux (vegan) leather, not animal leather. We make every effort to show colors and details accurately, but screens vary and finishes can vary slightly between production batches. Our cases are made to fit the iPhone models listed on each product page. They are a fashion accessory, not a drop-protection or waterproof device, and we're not responsible for damage to your phone or cards.
4. Choosing your model
You are responsible for selecting the correct iPhone model.
5. Prices and payment
Prices are in US dollars and may change at any time without notice; the price you pay is the one shown at checkout. Promotions such as The Duo or discount codes apply only as stated, can't be combined unless we say so, and may end at any time. Payment is processed securely by Shopify and its payment partners (including Shop Pay, Apple Pay, Afterpay and Klarna); we never see or store your full card number. Instalment plans are provided by those partners under their own terms.
6. Orders
Your order is an offer to buy. We may refuse or cancel any order, for example if an item is out of stock, a price was listed in error, or we suspect fraud. If we cancel after you've paid, we refund you in full.
7. Shipping, returns and refunds
These are covered by our Shipping Policy and Returns & Refunds Policy, which form part of these Terms.
8. Intellectual property
All content on the Site, including the name The Phone Purse, logo, photos, videos, text and design, belongs to us or our licensors. You may not copy, reproduce or use it commercially without our written permission. "iPhone" is a trademark of Apple Inc.; we are not affiliated with or endorsed by Apple.
9. Reviews and content you send us
If you post a review, photo or video, or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it to promote our products, with credit where practical. You confirm the content is yours and doesn't break any law or anyone's rights. We may remove any content at our discretion.
10. Acceptable use
Don't misuse the Site: no fraud, scraping, interfering with its security or operation, or using it for anything unlawful.
11. Disclaimer
The Site and products are provided "as is" to the fullest extent permitted by law. We don't guarantee the Site will always be available or error-free.
12. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the Site or a product is limited to the amount you paid for that product. We are not liable for indirect, incidental or consequential losses, including damage to or loss of your phone, cards or other belongings. Nothing in these Terms limits rights you have under consumer protection laws that can't be excluded.
13. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Site.
14. Governing law
These Terms are governed by the laws of the State of California, USA. Disputes will be handled by the courts there, unless the consumer laws of where you live give you the right to bring proceedings locally.
15. Changes
We may update these Terms. The version posted at the time of your order applies to that order.
